4. Open Market Agreements

($10,001 - $15,000)

If a school or other site within the New York City Public Schools require purchases greater than $10,000, but not to exceed $15,000, they must solicit a minimum of three sealed bids that must be opened in a public setting - a public place on a particular day, date and time. Although the dollar threshold is greater with the Open Market Agreement, the district, school or other site can purchase directly from vendors through the use of a purchase order. Vendors are selected based on the lowest responsible bidder meeting all terms and conditions of the specifications. When requesting bid pro-posals, schools and districts may also call the Division of Contracts and Purchasing to request vendors listed on our Bidder's List. You are encouraged to place your business organization on this Bidder's Listing for the reasons alluded to above as well as for other reasons which we shall discuss later. Procedures on how to get on the DCP Bidder's List can be found in Step 4 of this guide. Payment follows the procedures outlined in Step 8.

5. "City Record" and "Internet" Advertisement Necessary

($15,001 -$25,000)

As indicated above, the monetary thresholds for this method of purchasing are from $15,001 to $25,000. All of the requirements outlined for the Open Market Agreement (see number 4 to the left) is applicable for these purchases PLUS two additional requirements:

1. Advertisement in the “City Record.”

2. Advertisement in the “Mayor’s Office of Contracts” screen on the Internet.

Note: Purchases in excess of $25,000 also require a Formal Contract which is registered with the New York City Comptroller’s Office after award in conformance with the Department of Education’s contract procedures.
