Workers' Compensation Laws
are enacted to protect employees against loss of earning power through injury sustained in their employment. Workers' Compensation is insurance that provides cash benefits and/or medical care for workers who are injured or become ill as a direct result of their job.
The New York City Department of Education,
Workers' Compensation Unit is committed to providing the dedicated service necessary to process claims expeditiously and accurately.
The New York City Law Department Workers' Compensation Division
determines the validity of claims based on documentation submitted by the DOE. Therefore, it is essential that the following procedures be followed:
Employee
Obtain first aid or other necessary medical treatment as soon as possible. Inform the attending physician that your injury or illness is work related.
Notify your supervisor about the injury and the way in which it occurred, as soon as possible.
Complete the following forms and submit them to your supervisor/timekeeper.

Comprehensive Injury Report
Make sure that the timekeeper is notified of the dates that you are absent due to this injury so it may be coded in payroll accordingly. The application for a leave of absence without pay for WC must be forwarded to HR Connect for processing.
IMPORTANT NOTES
Always obtain care from a Workers' Compensation authorized doctor. For a listing of the participating WC physicians, please call 1 (800) 781-2362 or go to the New York State Workers' Compensation Board Web site at
http://www.wcb.state.ny.us/
Be certain to provide the WC Unit at the DOE with all essential information regarding your claim, eg lost time, date of return to work, notification of any reoccurrences, etc. so that this information can be reported to The Law Department in a timely manner, thus avoiding penalties.
Supervisor/Payroll Secretary
Ensure that the employee has received emergency medical treatment if needed.
Have employee fill out the necessary forms.

As of September 10, 2007 the DOE Workers Compensation Unit will no longer be accepting the "
Employer's Report of Work Related Accident/Occupational Disease
" form (C2) thru the mail. If you have access to the FAMIS portal, the link below will direct you to the portal login page.
Prior to entering a C2 on line for the first time thru the portal, you must contact the WC Unit at the DOE to be granted access in the portal for submission. For additional access in portal, please call (718) 935-2213. When calling, please provide your name, user id and DOE e-mail address. If you do not have access to the FAMIS portal, click on the link below "C2 form via Intranet" for submission. As a guide, we have provided a referance manuel.

Hearings
Employee - The employee is obliged to appear at the NYS Workers' Compensation Board when notified about a hearing regarding his or her case. (3 hours of time spent is charged to the Department of Education).
Supervisor - The Supervisor is responsible for supplying witnesses upon request from the New York State Workers' Compensation Board.
